Who we are and how we approach data privacy

We are:

  • TJ Transport Ltd. (Company Registration No. 02889704, Registered Office: Rubis House, 15 Friarn Street, Bridgwater, Somerset, TA6 3LH) – our bulk haulage arm; and
  • TJ Waste and Recycling Ltd (Company Registration No. 05117867, Registered Office: Rubis House, 15 Friarn Street, Bridgwater, Somerset, TA6 3LH) – our waste management arm.

We are a Controller for the purposes of the General Data Protection Regulation (Regulation (EU) 2016/679. In this notice we will use “TJ” to refer to us.

We are committed to protecting and respecting the privacy of your personal information. We want you to be confident that your information will be properly protected whilst in our possession.

This notice explains how we, and carefully selected third parties we work with, will collect and use the personal information of our customers, suppliers, prospects, users of our websites and job applicants. If this describes you, please read this notice carefully and make sure you’re comfortable with the content.

Our website

This notice explains how we use information you provide to us in using our websites:

  • https://www.pinkskip-hire.co.uk; and
  • https://www.tj-waste.co.uk;

collectively referred to in this notice as our “Site”.

Any external websites that may be linked to our Site will be subject to their own data protection statements/privacy notices which may be different to this notice. You should check the content of those third party notices carefully before you submit any personal information to them.

Unfortunately, the transmission of information through the internet is never completely secure. Although we do our best to protect your personal information at all times, we cannot guarantee the security of the data you send to us through our Site. Any transmission made is therefore at your own risk. Once we have received the information we use strict procedures and state of the art security features to protect against unauthorised access.

Information we collect from you and how we use it

We will only use your personal information when the law allows us to. Most commonly, we will use your personal information in the following circumstances:

  • where we need to perform the contract we are about to enter into, or have entered into, with you;
  • where it is necessary for our legitimate business interests and your interests and fundamental rights do not override those interests;
  • where we need to comply with a legal or regulatory obligation;
  • where you have given us your consent.

We hope the following table helps you to understand what information we may collect, in what circumstances and how we use that information (including how long we retain it for).

Payment for the order will be controlled and managed by sage Pay, Worldpay or direct bank transfer. You should ensure that you read the privacy notice of these providers and that you are comfortable with how they may independently process your personal information:

We need to process this information in order to enter into and perform our contract with you.

· purchasing our products and services (including processing and delivering your order) – by phone or through our Site using a trade credit account To process your account application we will request the following contact information (name/address/billing address/email address/date of birth/trade references) and financial information in order to process your payment where applicable.

Payment for the order will be controlled and managed by Worldpay or direct bank transfer. You should ensure that you read the privacy notice of these providers and that you are comfortable with how they may independently process your personal information:

· using our exchange/collection service; We will collect your account number (where applicable) name and address and payment details (where applicable) in order to facilitate your exchange/collection. This is the only information we require in order to perform our contract with you.

 

When organising your exchange/collection we provide a free text box for you to provide additional information you think is relevant to the service. This is optional and you should only add personal information in this text box if you are comfortable for us to process it in accordance with this notice.

·       signing up and using a customer portal on our Site (available to credit account customers only);

 

 

If you would like to make use of our customer portal on our Site you will be asked to create a username and password.

 

Please keep this information confidential; if you share your account username and password with anyone else this may compromise the security of your personal information.

When you log into the portal on our Site, the portal will collect your unique ID (username and password), your full name, address and contact number.

We provide our portal as part of our service to you. The processing of your personal information on this basis is either necessary for us to perform our contract with you or it is in our legitimate business interests.

· contacting us with an enquiry or to report a problem with our products/services or our Site; In order to process your enquiry and/or investigate a problem we may ask you to provide your contact information (name, address, email, phone number). We will only process this personal information to investigate and respond to you on the outcome of your enquiry/our investigation.

 

You do not have to provide this information, it is entirely optional. However, we may be limited in our ability to respond to you if contact information is not provided. We will only correspond with you in the way you have asked us to.

It is in our legitimate business interests to process this information in order to deal with your enquiry/investigate the problem you’ve raised. We’ll ensure your privacy rights are protected.

Some of our “contact us” functions contain a free text box for you to provide additional information you feel may be relevant. Again, completion of this field is optional. You should only add personal information in this text box if you are comfortable for us to process it in accordance with this notice.

· completing a survey; We occasionally run surveys to understand how you felt about our products/services and gather information about your experience.

 

We currently use a third party tool, Feefo, to seek feedback from users of our Site, products and services. We will provide Feefo with your name, email address and order number where applicable. We use this information to analyse the responses in the survey.

We will only use the information from the survey to improve our Site, products and services. Before you include personal information in the survey please read feefo’s privacy policy and make sure you’re happy with it: https://www.feefo.com/business/gb_en/privacy-policy

It is in our legitimate business interests to understand how you feel about our Site, products and services. This justifies the processing of your personal information for this purpose. Completion of the survey is entirely voluntary.

Please be assured that after initial collection of your personal information for a survey, your information will be anonymised to allow us to report back on our performance (internally and in our marketing communications).

· liaising with us in a business capacity; We keep:

 

·a record of contact information of suppliers, advisers, developers, architects, building surveyors, subcontractors and agents (“Business Contacts”) in order to manage our commercial relationship with that third party and perform contractual obligations;

· a record of contacts from competent authorities and regulators attached to our industry (such as our Health and Safety Advisor), together with their contact information (in order to comply with a legal obligation);

· a record of prospective Business Contacts. This is in our legitimate business interests (i.e. we have a justifiable reason for processing information in this way). Please note, in some instances we may source this information from publicly available sources.

· ex-employees and workers; We will retain your personal information after your employment or engagement in accordance with our separate PRIVACY NOTICE FOR EMPLOYEES AND WORKERS. · filling in a job application and the subsequent application process; If you apply for a job though our Site you will be asked to complete our online application form or submit a CV. This will involve submission of personal information about you (including your name, address (current and historic), telephone number, email address, job history and qualifications).

 

A free text box may also be provided to allow you to upload additional information you feel may be relevant to your application. Completion of this field is optional. You should only add personal information in this text box if you are comfortable for us to process it in accordance with this notice.

As part of your application you may be asked for equal opportunities information. This is optional. You do not have to supply it. Failure to provide this information will not impact your application. We will initially process this information with your consent.

All of the information you provide during the application process will only be used for the purpose of processing your application (prior to possibly entering into a contract), or to fulfil legal requirements. This includes any information collected during the interview process.

We will not share any of this personal information for marketing purposes. The information you provide will be stored securely by us and our data processors. This captures data in both electronic and paper form.

We will use the contact information you provide to keep you up to date on the progress of your application. We will use the other information you provide to assess your suitability for the role you have applied for.

If we may a conditional offer of employment or contract we may ask you provide additional information so that we can carry out pre-employment checks (such as proof of ID, proof of qualifications, referees, health information, driving licence status).

Information about your health is a special category of data and we will need your express consent to process it.

If you’re asked to provide referee contact information, please ensure you firstly have the consent of that information to provide his/her contact information to us.

You may also be asked to provide evidence of your right to work in the UK and/or complete a Disclosure and Barring Service check.

If you are successful in your application, we will provide you wish a further notice (a PRIVACY NOTICE FOR EMPLOYEES AND WORKERS) to advise how we handle the personal data of our staff, contractors and workers. You will receive a copy of this at your induction.

If you are unsuccessful we may ask for your consent to keep information on file in case any other opportunities arise which we feel may be of interest.

Your personal information will be held for the duration of the application process.

 

 

If successful, your personal information will be retained and held in line with your PRIVACY NOTICE FOR EMPLOYEES AND WORKERS.

 

If unsuccessful and you consent to us keeping your data on file, it will be held for 6 months. If you do not consent we will delete your data within 3 months.

Information we collect about you and your device Each time you visit our Site we will automatically collect the following information:

 

· technical information (including your operating system, the browse you use, time zone setting, browser plug in types and versions, your log in information and the internet protocol address used to connect your computer to the internet) (Device Information);

· details of your use of our Site (including the traffic data, he resources you use, where you have clicked through to our Site from that of a third party, the domain name of the connecting website, page response times, download errors, length of visit, page interaction and browsing behaviour) (Log Information).

Some online identifiers (such as your IP addresses) are your personal information.

 

We will collect anonymised Device Information so that we can ensure technical support for our Site and ensure it is functioning properly on all our operating systems/browsers. We want to ensure the content of our Site is presented to you in the most appropriate way to ensure it is easy to use/navigate. We also need this information in order to allow you to participate in interactive features on the Site where you choose to do so. We want to be responsive to your needs. Device Information can help tailor the Site operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We collect anonymised Log Information so that we can better understand how our Site is used (such as which pages are of interest) and improve its functionality/content. We want to provide you with a customised service. We only use this information for statistical analysis purposes and the data is usually removed from your system over time, dependent on your browser settings.

These activities are in our legitimate interests (i.e. we have a justifiable reason for processing your information in this way).

The above are features of Google Analytics Solutions Software to track and report on general patterns of activity on our Site at statistical level. We use cookies and pixel tags on our Site:

·       a cookie is a small text file placed on your computer/device according to your browser settings;

·       a pixel tag is an invisible tag placed on certain parts of our Site. It does not leave a footprint on your computer/device.

Pixel tags and cookies work together to tailor our Site. These are also used in our email communications to understand whether you have used our Site from the email and record whether it has been read.

You can choose to accept or decline cookies. You can manage this collection of data by adjusting your cookie settings at any time or by using the tool located in the bottom left of your window. Information we collect from third parties We work closely with the third parties listed in this section. We carefully select the third parties we work with to ensure they handle personal information in line with our standards and those required by law. Recruitment agencies:

 

We work with various agencies including, but not limited to, Jobsite/Driver Hire/Driver personnel/Driver Hire Bristol/Drivers direct recruitment/the logistics partnership/Workchain/Wild recruitment to identify candidates who may be interested in a position with us. You would have consented to these recruitment agencies passing information to us for this purpose.

Development and construction databases/information:

We have a commercial relationship with Glenigan (www.glenigan.com) and local developers who provide us with information on UK construction and development projects. It is in our legitimate business interests to process any information we receive through these channels.

Credit reference agencies (credit account customers only):

We use credit reference agencies for the purpose of assessing credit worthiness. This is only done for credit account customers. As this is a check on company status very limited personal information is processed. We will carry out this check on the basis that it is in our legitimate business interests and your privacy rights are protected. The search does not leave a hard footprint on your credit history.

Information we collect from publicly available sources We may collect basic contact information from publicly available sources on prospect suppliers, business contacts and employees. We will only collect name, job title, email address and contact telephone number. We consider it in our legitimate business interests to collect such information which may assist in the growth of our business. Social media accounts

If you connect to our Site through a social media account or platform, we may temporarily have sight of a link to your profile and your picture (where this is publicly available information or you have agreed to share it). We do not record or retain any information contained within, or linked to, a social media account (including your profile).

Do I have to provide this information?

In most cases the personal information you provide to us in the table about is entirely voluntary. You are not under a statutory or contractual obligation to provide it to us. The only exceptions are:

  1. Information we require to complete your order for goods/services. This is a contractual If you fail to provide personal information in this capacity we may not be able to provide the goods and services you require;
  2. Where you work for a company which has a contract with TJ and you are involved in the performance of the contract/named as the relationship manager for that company. This is a contractual requirement. If you fail to provide your personal information your company may not be able to fulfil its contractual obligations to us;
  3. Where you apply for a job with TJ and we have given you a conditional offer. Our offer may be conditional upon you providing evidence of your identity and/or your right to work in the UK and/or (if applicable) your driving licence. This is a legal If you fail to provide this personal information we may not be able to offer you employment.

Keeping your personal information up to date

If you become aware that any information we hold about you is incorrect, incomplete or there are any changes to your personal details, please contact us. We will promptly correct any information found to be incorrect or inaccurate.

Providing us with personal information of another person

If you need to provide us with personal information about another person you must obtain that individual’s express consent to pass us their information. You should share this notice with those individuals as it may also apply to them.

Marketing

  • Marketing to companies and corporate bodies 

We will communicate information about our products and services to companies and corporate bodies (forming a view on what those recipients may need, or want, or what may be of interest). We consider this to be in our legitimate interests which are balanced (not overridden) by the interests and fundamental rights of any identified individual. For any calls we may make to companies and corporate bodies, we will screen the number we hold against the Corporate Preference Service and will provide the recipient with the option to stop further calls. We will advise and request consent that our calls will be recorded, if the individual on the call does not consent that call will be terminated. For any emails we send to company and corporate bodies, we will offer a route to unsubscribe from those communications/allow individual employees to unsubscribe (within the communication). This option to unsubscribe can also be exercised at any other time by contacting us at: enquiries@tj-group.co.uk. Where an individual unsubscribes we will still process his/her personal information to fulfil a product or service made by the company/corporate body (or where we have another lawful basis for doing so).

 

  • Marketing to our customers

We strive to provide you with choices regarding use of your personal information for marketing/advertising. We have established a preference management centre where you can view and make certain decisions on our use of your personal data for these purposes. A link to this preference centre is contained within all our electronic communications.

If you have consented to receive marketing from us or we are permitted by law to market to you, we will use your personal information to communicate with you on products or services that we provide that we think you may want, or need, or which may be of interest to you. We determine this by looking at your purchase history or the preferences you have set for content and method of communications.

Our products and services comprise, in summary:

  • Tipper, Skip or Grab hire;
  • Commercial Waste Management; and
  • Aggregate sales/delivery.

If you have consented we will also send you newsletters of general interest with updates on our company, products and services.

You can ask us to stop sending you marketing messages at any time by emailing us at: enquiries@tj-group.co.uk or by following the unsubscribe links on any marketing message sent to you.

  • Marketing to other individuals identified in this notice

We will not use your personal information to directly market to you.

  • Sending personal information to us from third parties

If you send personal information to us indirectly through the third parties we work with (such as recruitment agencies) these third parties will be in control of your personal information. You should check their privacy notices to ensure you’re comfortable with their marketing activities and the marketing you have consented to.

Children

We do not collect or hold personal information about children (beyond that relating to children of our employees held for legitimate purposes).

Where we send your personal information

We may have to share your personal information with the parties set out below for the purposes set out in the above table.

  1. carefully selected third parties who provide a service to us to support our core operations, such as processing our mail, communicating with customers and prospective customers on our behalf, providing IT and administrative services and the development and improvement of internal systems and processes;
  2. our sub-contractors in order to fulfil our service contract with you (only location information will be shared);
  3. our payment providers, sage Pay and worldpay;
  4. our survey provider, feefo;
  5. competent authorities (statutory bodies, regulation authorities, authorised bodies who have a role laid out be law);
  6. other opportunities where we are legally obliged to disclose your personal information (such as requests made in the prevention or detection of crime) or where disclosure is necessary to protect the property, rights and safety of us and our staff;
  7. third parties to whom we chose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then new owners may use your personal information in the same way as set out in this privacy notice;
  8. other companies where we are trialling products and services which we consider may improve our offering to customers and/or our business processes; and
  9. other third parties where you have given consent or where we reasonably believe a third party is acting on your behalf.

We require all third parties to respect the security of your personal information and to treat it in accordance with the law. We do not allow our third party service providers to use your personal information for their own purposes (unless you have personally agreed to this) and only permit them to process your personal information for specified purposes and in accordance with our instructions.

Whenever we share your personal information with third parties we will take all reasonable steps to ensure appropriate safeguards are in place to protect your personal information and your privacy rights.

Where we store your data and keeping it secure

The data you provide to us as set out above may be transferred to, and stored at, a destination outside of the European Economic Area (EEA) by us and/or by the carefully selected third parties we work with.

Where your data is stored outside of the EEA, we will ensure this is to a country which has been deemed adequate by a competent data protection regulator or where adequate protections have been put in place to safeguard the data (to the same standards as prescribed within the EEA). This includes contractual protections.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this notice.

We are committed to ensuring that your personal information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know.

We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

Automated decision making

We do not envisage that any decisions will be taken about you using automated decision-making. Automated decision-making takes place when an electronic system uses personal information to make a decision without human intervention.

Your rights

We recognise that the personal information we hold about you belongs to you and it is right that you have control over that personal information. We have detailed below a summary of your legal rights.

You can:

  • ask us to have access to, and for a copy of, the personal information we hold about you;
  • request that we amend or delete your personal information;
  • ask us to stop processing your personal information altogether or in a certain way;
  • change your mind about how you have agreed we can use your personal information. If you have given us consent to use your personal information in a specific way you can withdraw it. This means that we will stop processing personal information in the way you have objected to from the date that your permission is withdrawn;
  • issue a complaint to a competent authority – see www.ico.org.uk for more information;
  • request that we transfer your personal information to another provider (this is known as data portability);
  • object to automatic processing.

We need to make you aware that even where you exercise a right detailed above, we may not be able to comply with your request if an exception in law applies. Where this is the case we will notify you and explain why we’re unable to meet your request.

Changes to this notice

We keep this notice under regular review. This notice was updated on 24 May 2018.

Any changes we make to this notice will be posted on our Site with a prominent notice and, where appropriate, we will notify you by email. You should check our Site from time to time to familiarise yourself with the latest version of this notice.

If, in the future, we wish to use your personal information in a way not set out in this notice we will notify you and ask your permission to do so.
